Terms & Conditions
Please read these terms and conditions carefully before using our platform. By accessing or using our services, you agree to be bound by the following terms.
Interpretation
"we" means Ardent Sailing Ltd (and "us" and "our" will be construed accordingly); "you" means our customer or potential customer for products (and "yours" will be construed accordingly).
Terms of sale
In order to enter into a contract to purchase products from us, you will need to create an account with us and log in or enter your login details before purchase. By ordering through our website, you consent to these terms of sale, and you will be transferred to the payment website — a third party will handle your payment. We will then send you an acknowledgement and receipt (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.
We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. Therefore, we recommend that you download, print and retain a copy of these terms of sale for your records.
The only language in which we provide these terms of sale is English.
Prices for products are liable to change at any time, but changes will not affect contracts that have come into force.
Payments for course fees are due, in full, at the time of purchase. Payment can be made using our checkout procedure online.
Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).
Returns and refunds policy
Under distance selling regulations you have a statutory cooling-off period of 14 calendar days from the day you receive your student pack. At any time during this period, you can notify us that you wish to cancel your contract with us and your course fees will be refunded on return of the undamaged student pack (all items sent via post).
The course materials must be returned in an 'as new' condition and the postage paid. Should a refund be requested, access to the online course material will be terminated immediately. If the student pack and/or its contents have been damaged, this will be deducted from your refund accordingly.
If you cancel a contract and are entitled to a refund, we will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 30 days of the day we received your valid notice of cancellation.
Student packs
The student pack will be sent on either the same day or the next working day. We will not be held responsible for packs sent to 'care of' addresses of any type including businesses and marinas. Replacement materials for those lost after delivery will be at the sole expense of the purchaser, including postage and handling fees. Pack contents must be checked on arrival. A list of the contents is provided on the welcome letter in the pack, or you can get in touch if you are unsure. No replacements for breakages or missing items will be made after the fourteen-day returns period.
Course access, compatibility and expiry
Your course access period starts from the date the payment is received and you are logged into the system. You must have access to the internet to complete the course. The courses have been tested on Apple, Microsoft and Android phones, tablets and laptops, but there are far too many devices for us to check every model. If you experience any issues with your device please get in touch so we can help you find a solution. If you have concerns, please check that the free trial runs on your device before booking.
Your course fee covers 12 months of access. Most students complete their course within 4 months, and access can be extended for an admin fee of £36. Accounts that remain inactive and unextended for a period of 6 months following access expiry may be permanently deleted. Where possible, we will notify you by email prior to deletion.
Student obligations
It is your responsibility to ensure that you have the correct prior knowledge and experience before enrolling on a course.
The Essential Navigation and Seamanship course requires no previous experience or knowledge.
The Day Skipper Shorebased course requires no previous experience, though some practical experience is desirable.
The Coastal Skipper/Yachtmaster Offshore theory course requires knowledge to the level of Day Skipper Shorebased.
The Yachtmaster Ocean course requires navigation to Coastal Skipper & Yachtmaster Offshore Shorebased standard.
The Fast Track to Coastal Skipper/Yachtmaster Offshore course is suitable for those with practical skills and experience skippering yachts.
We reserve the right to change a course enrolment if it becomes apparent that you do not have the required pre-course knowledge.
The course must be completed by you and cannot be shared.
None of our courses are attendance or solely results-based. Certificates can only be obtained once all of the coursework has been completed as well as the final assessment and any additional study requested by any of our instructors.
We have a zero-tolerance policy and reserve the right to remove a student's access from their course should we believe you have acted inappropriately towards our staff or other students. Should you feel that the course or your instructors have not met your expectations at any point, please make it known to us as soon as possible so that we have the opportunity to rectify the problem.
All complaints regarding course content should be directed to instructor@ardent-training.com. Complaints regarding instructor conduct may be directed to the principal of Ardent Training at ehewett@ardent-training.com.
Our obligations
Included in your course is access to qualified RYA instructors from 0800–2000, 7 days a week for the duration of your course. You may contact us by whatever method suits you, although our built-in messaging service is preferred.
Certificates are issued in line with RYA guidelines. Should your instructor decide that you have not reached the required standard after completing the coursework and the assessment, they will work with you to determine the course of action required to develop the skills and knowledge required.
In addition to course support from your instructor, we may contact you regarding your course access, account, or feedback. This will normally be done via email.
Legal
Any contract between you and us shall be governed by Scottish law and the courts of Scotland shall have non-exclusive jurisdiction over any dispute. All dealings, correspondence and contact between us and you shall be made or conducted in the English language.
Every effort has been made to ensure the accuracy of course information. However, we cannot accept any liability for errors, omissions or inaccuracies in the course content. We continuously improve the course content and we do welcome any feedback from students which improves the quality of the course.
All online material has been written and is under copyright to us. No part of the online documents can be reproduced, stored in or introduced into a retrieval system, or transmitted in any form or by any means (electronic, mechanical, photocopying, recording or otherwise) or for any purpose, without the express written permission of us.
Data protection
We do not store or have access to any of your credit card information. Payments are managed securely by Stripe or PayPal depending on your choice of payment method.
